Privacy Policy

Last Updated: February 13, 2025

Introduction

This Privacy Policy explains how Sailor Health, Inc. (“Sailor Health”, “Company”, “we”, “us”, or “our”) collects, uses, discloses, and otherwise processes your personal information. We are committed to protecting your privacy and ensuring the security of your data. This Policy applies to personal information we collect through our websites, mobile applications, and related online services (collectively, the “Services”). By using our Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree, please do not use our Services.

When we use the term “personal information” in this Policy, we mean any information about you that can identify you, such as your name, contact details, or other data that can be reasonably linked to you. Personal information does not include data that has been de-identified or aggregated so it cannot be used to identify an individual.

Health Information: Please note that if you receive healthcare services through Sailor Health, any health or medical information we collect about you (which may be considered Protected Health Information under HIPAA) is subject to additional protection. Sailor Health maintains a separate Notice of Privacy Practices (in accordance with HIPAA and other applicable laws) that describes how we use and disclose health or medical information. To the extent any information we collect is health information protected by law, that information is governed by the Notice of Privacy Practices rather than this Privacy Policy. This Privacy Policy covers other personal information collected in connection with your use of our Services outside of your medical care.

Personal Information We Collect

We collect personal information from and about you in a variety of ways when you use our Services. The types of information we may collect include:

  • Information You Provide to Us: When you interact with Sailor Health, you may provide certain personal details. For example, when you create an account, fill out forms, or request information about our Services, we collect information such as your name, email address, phone number, date of birth, and any other information you choose to provide. If you contact us for support or with inquiries, we will collect the information you submit in those communications.
  • Service Activity Information: We track certain actions you take on our website or app. This includes data about your usage of the Services, such as the content of searches or queries you perform, pages or features you access, and links you click. For instance, if you sign up for a newsletter or request more information about our Services, we will collect the information you enter (e.g. your name, email address, phone number, and any preferences or questions you submit).
  • Device and Browser Information: When you access our Services, we automatically receive information about the device and browser you use. This may include your Internet Protocol (IP) address, device identifiers, browser type, device type or model, operating system version, mobile network provider, and the date and time of your access. We use this information to ensure the Services function properly across different devices, to troubleshoot issues, and to secure our platform.
  • Location Information: Certain features of our Services may request access to your location data. For example, we might collect real-time location information (such as GPS coordinates) from your mobile device if you grant permission, in order to connect you with healthcare providers or resources available in your area or state. You can choose not to share exact location information by adjusting your device settings; however, disabling location access may affect some functionality of the Services (for example, our ability to match you with a provider licensed in your region).
  • Cookies and Similar Technologies: Like many online services, we use cookies, web beacons, pixels, and similar tracking technologies to collect usage data and improve your experience. Cookies are small data files stored on your browser or device. We use both session cookies (which expire when you close your browser) and persistent cookies (which remain for a set period or until deleted) to remember your preferences, authenticate users, and enhance security. For instance, cookies help us keep you logged in, track site analytics, and personalize content. You can control or delete cookies through your browser settings. Please note that if you disable certain cookies, some features of the Services may not function properly.
  • Analytics Information: We utilize third-party analytics tools (such as Google Analytics and similar services) to understand how users engage with our Services. These tools use cookies and device identifiers to collect information about usage and performance, such as which pages you visit, how long you stay, how you arrived at our site, and how you interact with our content. This information helps us analyze trends, administer and improve the Services, and gather aggregate demographic information about our user base. The data collected by these third-party tools will be subject to the third party’s privacy policies. For example, Google Analytics may set its own cookies; you can opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on. We do not allow these analytics providers to use the information collected for their own marketing purposes.
  • Log Files and Technical Data: Our servers automatically record certain information (“log data”) when you use the Services. This log data may include information such as your IP address, browser type, referring/exit pages, and system activity. We collect this data to monitor the performance of our Services, detect and prevent fraud or abuse, and ensure the security of our systems.

In many cases, the information we collect (such as usage statistics or technical data) is not directly identifiable to you on its own. However, if we link this information with other personal details such that you can be identified, we will treat the combined data as personal information in accordance with this Privacy Policy and applicable law.

De-Identified and Aggregated Data: We may create de-identified or aggregated datasets from personal information by removing or masking details that could personally identify you. We use this de-identified data for legitimate business purposes — for example, to analyze usage trends or improve our services — and we may use or share de-identified data without restriction, since it does not identify any individual. This information will not be re-identified in a way that could associate it with you.

How We Use Your Personal Information

We may use the personal information we collect for various purposes in order to operate, improve, and personalize our Services. These purposes include, but are not limited to, the following:

  • Providing and Improving Services: To provide you with the Sailor Health Services and all its features, and to ensure the Services function as intended. For example, we use your information to create and manage your user account, facilitate appointment bookings or referrals, and allow you to communicate with healthcare professionals. We also use information to improve and optimize our platform’s performance and develop new features.
  • Communication: To communicate with you about your account or any services you receive. This includes sending you administrative messages such as appointment reminders, confirmations, updates on transactions or changes to our terms, responses to your inquiries, and customer service communications. We may also notify you when software or app updates are available, or of any issues with the Services.
  • Marketing and Promotions: To market and promote our Services to you. We may use your contact information to send you newsletters, educational content, or promotional materials about new features, services, or resources that might be of interest to you, only in line with the preferences you have shared with us or with your consent. (You can opt out of marketing communications at any time by contacting us or using the unsubscribe mechanism provided in the emails or messages.)
  • Analytics and Personalization: To analyze usage of our Services and personalize your experience. For instance, we may use data to understand what parts of the Services are most useful to users, to tailor content or recommendations to your interests, and to improve the user interface and functionality based on how you and other users interact with the platform.
  • Legal and Security: To maintain the safety, security, and integrity of our Services. Your information helps us verify user identities, prevent fraud or unauthorized activities, enforce our terms of service, and comply with applicable laws and regulations.
  • Creating De-Identified Data: To create aggregated, anonymized statistics or reports that we can use to monitor business performance, research general usage patterns, or share with third parties (such as healthcare partners or researchers) for lawful purposes. Any data shared in this way will not personally identify you.
  • Other Purposes with Your Consent: We may use your personal information for any other purpose that is disclosed to you at the time you provide the information, or for which you separately give consent. For example, if you provide a testimonial or participate in a survey, we will use your information for that specific purpose with your agreement.

We will only use your personal information in ways that are consistent with the reasons it was collected and as outlined in this Policy. If we need to use your information for an unrelated purpose, we will notify you and obtain your consent or ensure we have a lawful basis for the new use.

How We Share Your Personal Information

We understand the importance of keeping your personal information private. Sailor Health does not sell your personal information to third parties. We only share or disclose your information in limited circumstances, as described below, and never for third-party marketing use. The situations in which we may share personal information include:

  • Service Providers and Vendors: We may share your information with trusted third-party service providers who perform services on our behalf to support our operations. This includes, for example, IT hosting providers, cloud storage services, analytics companies, communication providers (such as email or text messaging services), customer support tools, or other vendors we use to help deliver the Services. These third parties are contractually bound to protect your information, maintain its confidentiality, and use it only for the specific services they are providing to us. They cannot use your information for their own unrelated purposes.
  • Legal Compliance: We may disclose your information if required to do so by law or legal process. For instance, we will share personal data in response to a court order, subpoena, or other lawful government request. We may also share information when we believe in good faith that such disclosure is necessary to comply with the law, to enforce or apply our Terms of Service or other agreements, or to protect the rights, property, or safety of Sailor Health, our users, or others.
  • Protection of Rights and Safety: If we believe it is necessary or appropriate, we may share information to investigate, prevent, or act against suspected fraud, illegal activities, situations involving potential threats to the physical safety of any person, or violations of our policies or agreements. This includes exchanging information with other companies and organizations for the purposes of cybersecurity protection, fraud prevention, and risk reduction.
  • Business Transfers: In the event that Sailor Health undergoes a business transaction such as a merger, acquisition, reorganization, sale of assets, or bankruptcy, your personal information may be disclosed to a successor or affiliate as part of that transaction. We will ensure that any such successor is bound by privacy obligations consistent with this Policy and that they only use and disclose your information for the purposes we originally collected it. If a transfer of your information occurs, we will notify you (for example, via a notice on our website or an email) of any choices you may have regarding your information.
  • With Your Consent or Direction: We may share your personal information with third parties if you specifically request or direct us to do so, or if you give us consent at the time of sharing. For example, if you ask us to share your information with a family member, caregiver, or another service, we will do so with your authorization. We may also disclose your information for any other purpose that was described to you when collecting your data, provided you agreed to that disclosure.

No Selling or Unauthorized Sharing: We do not sell personal information to data brokers or other third parties. We also do not share your personal data with third parties, affiliates, or partners for their own marketing or promotional purposes. This includes your contact information such as your phone number and any information about your marketing preferences or consent. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. In other words, any information you provide to opt-in to text messaging or any consent you give for communications will be kept strictly within Sailor Health and will not be disclosed to any external party.

Please note that when we share information with service providers or others as described above, we require that they use the information only for the purposes we’ve specified and that they protect it in accordance with applicable privacy laws.

Also, this Privacy Policy only addresses the collection, use, and sharing of information by Sailor Health. If you choose to use any third-party websites or services that link to or integrate with our Services, those third parties will have their own privacy practices and policies. We are not responsible for the privacy practices of any third-party websites, services, or applications that you might access through our platform. We encourage you to review the privacy policies of every third-party service you interact with to understand how they handle your data.

Third-Party Websites and Links

Our Services may contain links to websites or services that are operated by third parties (for example, a link to an educational resource or a partner organization’s site). This Privacy Policy does not apply to information collected on or through any third-party websites, applications, or services that you may access via those links. Sailor Health is not responsible for the privacy practices of other sites or services. Once you leave our website or apps, or interact with a third-party link, any information you provide to those third parties is not governed by our Policy. We strongly encourage you to read the privacy statements of any third-party websites or services you visit before providing any personal information to them.

Your Rights and Choices

We want you to have control over your personal information. Depending on your relationship with Sailor Health, you have certain rights and choices regarding the information you have provided to us:

  • Accessing and Updating Your Information: You may review, correct, or update certain personal information by logging into your Sailor Health account (if you have one) and accessing your profile or account settings. For example, you can update your contact details or notification preferences through your account at any time. If you need to change any information that you cannot modify directly through the Services, you may contact us at support@sailorhealth.com for assistance. We will take reasonable steps to update or correct your information as requested.
  • Opt-Out of Marketing Communications: If you have subscribed to receive marketing emails or newsletters from us, you can opt out at any time. To stop receiving promotional emails, click the “unsubscribe” link in any email you receive, or adjust your account email preferences if available. You can also contact us at support@sailorhealth.com to request removal from our marketing lists. Please note that even if you opt out of marketing messages, we may still send you transactional or administrative communications (such as appointment reminders, security alerts, or notices about your account or our ongoing business relations).
  • Requesting Deletion of Your Information: You have the right to request that we delete personal information we have collected from you. You may send such requests to support@sailorhealth.com. Upon receiving a verified request, we will delete your personal information from our active databases, unless retaining the information is necessary for us to comply with legal obligations or other exceptions under applicable law. For example, we may need to keep certain records to comply with healthcare regulations, tax or accounting requirements, to resolve disputes, or to enforce our agreements. We will inform you if we are unable to delete certain data due to legal requirements.
  • Limitations on Deletion: Please understand that there are circumstances in which we cannot fully delete all of your data. We may retain your personal information if required by law, or for legitimate business purposes permitted by law. Additionally, even after we delete information from our active systems, it may remain in our backup archives or logs for a period of time until those are purged in the normal course of business. We also might have already shared your information with authorized service providers (as described above), and we may not be able to force those providers to delete information that they are legally allowed or required to retain. However, we will make reasonable efforts to communicate deletion requests to third parties with whom we have shared your data when feasible. Importantly, after we delete your personal information, we may retain and use de-identified data (which can no longer identify you) for purposes of research, analysis, or improving our Services.
  • Cookies & Tracking Choices: As described in the “Cookies and Similar Technologies” section, you have control over cookie settings on your browser. You can usually modify your browser settings to decline cookies or alert you when cookies are being sent. If you do not want data collected by Google Analytics, you can install the Google Analytics opt-out add-on in your browser. For mobile apps, you can reset your mobile device’s advertising identifiers or limit ad tracking via your device settings.

If you have any questions about managing your information or need assistance exercising your rights, you can always contact us at the email address provided in the Contact Us section below.

  • Right to Know: You have the right to request information about the categories and specific pieces of personal information we have collected about you, as well as the categories of sources of that information, the business or commercial purpose for collecting it, and the categories of third parties with whom we share personal information. You also have the right to know if we have sold or shared your personal information. However, as noted above, Sailor Health does not sell personal information to third parties.
  • Right to Delete: You have the right to request that we delete personal information we have collected from you, subject to certain exceptions (for example, we may retain information as required by law or for legitimate business purposes such as those described in the “Limitations on Deletion” section above).
  • Right to Correct: You have the right to request correction of inaccurate personal information that we maintain about you.
  • Right to Opt-Out of Sale or Sharing: California residents have the right to opt out of the sale or sharing of their personal information. As noted, Sailor Health does not sell personal data. • Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights. This means we will not deny you services, charge you a different price, or provide a different level or quality of service just because you exercised your privacy rights.

To exercise your California privacy rights, you or your authorized representative may submit a request to us by emailing support@sailorhealth.com with the subject line “CCPA Request” and detailing your specific request. We may need to verify your identity (for instance, by confirming information we already have on file) before processing certain requests, to ensure we protect your information against fraudulent requests. We will respond to verifiable requests within the timeframe required by law (generally within 45 days, with the possibility of an extension).

For more detailed information about your rights under California law, you can refer to the text of the CCPA/CPRA or contact us for clarification. Please note that these rights apply only to California residents; however, regardless of your residency, we strive to honor privacy rights and will endeavor to fulfill requests to access or delete personal information as outlined in the Your Rights and Choices section above, in accordance with applicable law.
